at the price w[hi]ch he then last talked of And he further saieth that vpon that friday in the open market at Smithfeild the said Gray came to this deponent and and ther did take the said sheep accept of the bargaine of the said 84 sheep together giving this deponent then other 20 s. of the said sheep was to earne of the whole bargaine together betwixt this deponent and him and then this deponent deliuered him the said sheep into his possession and not before and vpon the Saturday next after receaved his money for the same Examinant coram me Ja: Altham Richard Higginson Michell Dover of London Serievend aged 30 yeres or therabouts sworne and examined the day and yere xxvijth day of January in the yere abouesaid being by discrecd examined only to the first and fourth articles by vertue of his oath deposeth & saieth as followeth namely To the 4th interr[rogati]o[n] this deponent saieth that in November the xxvijth of November October 1609 the said defend[an]t Graye did paye to this deponent for by Richard Higginson his appointment fiftye pounds and odd money and to the said Higginson himselfe some other some for certaine sheep w[hi]ch the said Gray or his sonn then sick was so marryed in the house of Richard Higginson at Stratford in Shropshire in London lately before had bought of the said Higginson & And the said Gray and Higginson then making having some Conference about that bargaine the said Higginson affirmed that they had some Conference of aboue a bargaine for the said sheep before their coming into Smithfeild but that not was at the said bargaine but those yet to that newe bargaine then was at Chester when the said sheep came into Smithfeild were to take the same at the price to refuse to stand w[i]th the barbarene before conferrely before talking of betwixt them or to to a boxe or to the barbarene w[i]th the same leave them then if he did not of them at that price And to the residue of this article he can answer nothing.
